Big Island and Back Paddle Event – Activity Waiver and Release of Liability

I acknowledge that participating in this athletic event is an extreme test of a person’s physical and mental limits and carries with it the potential for serious injury, death, and property loss. Risks include, but are not limited to: the actions or negligence of other participants, volunteers, spectators, coaches, event officials, monitors, and producers; inadequate hydration; and weather or other natural conditions. I willingly assume all risks associated with participating in this event.

I further acknowledge the inherent risks specific to water-based activities, including but not limited to: drowning, capsizing, strong currents, submerged hazards, exposure to cold or inclement weather, collisions, and equipment failure.

I certify that I am physically fit, have sufficiently trained for this event, and have not been advised otherwise by a qualified medical professional. I agree not to participate in the event under the influence of alcohol or any substance that could impair my judgment or physical ability.

I understand that this Accident Waiver and Release of Liability (AWRL) will be used by Freshwater Society and the event sponsors and that it will govern my actions and responsibilities during the event.

In consideration of my participation, I hereby, for myself, my executors, administrators, heirs, next of kin, successors, and assigns:
• (A) Waive, release, and discharge from any and all liability for death, disability, personal injury, property damage or theft, or any actions of any kind that may occur before, during, or after the event, the following entities or persons: Freshwater Society; its directors, officers, employees, volunteers, representatives, and agents; event sponsors; and event volunteers;
• (B) Indemnify and hold harmless all the entities or persons listed above from any and all liabilities or claims made by other individuals or entities as a result of my actions during this event.

I acknowledge that I am responsible for the condition and safety of any personal equipment I bring and use during the event.

I understand that Freshwater Society does not provide health, accident, or medical insurance for participants, and I am responsible for securing my own medical coverage.

I consent to receive medical treatment that may be deemed necessary in the event of injury, accident, or illness during this event.

I understand that photographs or videos may be taken during the event or related activities. I grant permission for my image and likeness to be used in any legitimate promotional materials by the event organizers, sponsors, and their assigns.

This AWRL is intended to be interpreted as broadly as permissible under applicable law. If any provision is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
